Two independent Colorado attorneys have now reviewed the Colorado CARE Act's independence provision - the clause that decouples accommodation rights from leave eligibility - and reached the same conclusion: no preemption problem. The provision holds.


The same week, Senator Mike Weissman, who chairs the Judiciary Committee in the Colorado Senate, confirmed that the lack of immutability is not a legal barrier to protected class status for family caregivers.


The legal argument is won. The political argument - enforcement mechanism, coalition, sponsor - is next.
